Please read these terms and conditions of use before using this website. By accessing and using this website at www.propertywikia.com (the "website"), you explicitly agree to comply with and be bound by the following terms and conditions (the "Terms of Use").

PropertyWikia reserves the right to change or modify these Terms of Use or any policy or guideline of the website, at any time and in its sole discretion. Any changes or modification will be effective immediately upon posting of the revisions to this website, and you waive any right you may have to receive specific notice of such changes or modifications. Your use of the website following the changes and/or modifications will confirm your acceptance of such changes or modifications. Please review these terms and conditions periodically and check the version date for changes. There may be other rules or guidelines which we post from time to time throughout this website; these are incorporated by reference into the Terms of Use even if not explicitly mentioned in the agreement below.

1. General

1.1 PropertyWikia, its subsidiaries and parent company (collectively, "PropertyWikia") provide you with access to this website and its services (collectively, the "Services"). Access to and use of the Services is governed by these Terms of Use.
1.2 PropertyWikia provides an advertising service and displays information relevant to the sale and purchase of real estate property. It also provides an online database of properties for sale which when searched, displays property listing information. We reserve the right to add new content and services at any time. Unless explicitly stated, any new content or services provided are subject to these Terms of Use.
1.3 PropertyWikia is not a Multiple Listing Service (MLS) nor is it affiliated with any Multiple Listing Service. The professionals of PropertyWikia do not represent you when you advertise property on PropertyWikia.com. You do not sign a listing contract when you advertise on PropertyWikia.com and you do not pay a commission to PropertyWikia when you sell your property.

2. Services

2.1 The Services include the PropertyWikia Website, PropertyWikia Quicksearch, PropertyWikia Voices, PropertyWikia Overseas and other content, products and/or services available on the website.

3. Third Party Advertising

3.1 PropertyWikia runs advertisements and promotions from third parties on the website.
3.2 Your business dealings with or participation in the promotions of such third parties and any terms, conditions, warranties, or representations associated with such dealings or promotions, are solely between you and such third party.
3.3 PropertyWikia is not responsible for and does not guarantee the price, terms, performance, quality, accuracy, availability or legality of any products, services, promotions or information offered by any advertiser.
3.4 PropertyWikia is not responsible or liable for any loss or damage of any sort incurred as the result of such dealings or promotions or as a result of such third party information or advertisements on the website.
3.5 If you have a dispute with an advertiser, you agree to release PropertyWikia from any claims, liability, demands and damages to include consequential of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

4. User Submitted Content

4.1 You are solely responsible for any properties, messages, reviews, text, photos, videos, graphics, code, or other content (the "User Content") that you post, submit, publish, display or link to on the website or send to other PropertyWikia users.
4.2 You agree not to post, submit or link to any User Content or material that infringes, misappropriates or violates the rights of any third party, including without limitation the copyright, trademark, trade secret, patent, publicity, privacy or other intellectual property rights of any third party or that is in violation of any worldwide or local law, rule or regulation.
4.3 You also agree not to post, submit or link to any User Content that is defamatory, obscene, pornographic, indecent, harassing, threatening, abusive, inflammatory, or fraudulent or that is purposely false or misleading.
4.4 Without limiting the foregoing, you will at all times adhere to these Terms of Use.
4.5 You agree that by posting content on this website, you are granting PropertyWikia a royalty-free, perpetual, irrevocable and fully sub-licensable license to publish, reproduce, distribute, display, adapt, and otherwise use this content in any manner on or in connection with the website or in the course of offering the Services.
4.6 You understand and agree that any User Content that you post or submit to PropertyWikia may be redistributed through the internet and other media channels, and may be viewed by the general public.
4.7 For specific advice on legal, financial or real estate matters, you should always seek the advice of a professional who is licensed and knowledgeable in that area, such as an attorney, accountant or real estate agent or broker.
4.8 You understand that PropertyWikia does not approve or control the User Content posted by others, and instead simply provides a service by allowing users to access information that has been made available by others.
4.9 As a provider of interactive services, PropertyWikia is not liable for any statements, representations, or User Content provided by its users on the website or in connection with the Services.
4.10 PropertyWikia assumes no responsibility for monitoring the website or the Services for appropriate User Content or conduct and has no obligation to screen, edit, or remove any of the User Content. However, PropertyWikia reserves the right, in its sole discretion and without notice, to monitor, screen, edit, or remove any User Content at any time and for any reason or for no reason.
4.11 PropertyWikia nonetheless assumes no responsibility for such User Content or for the conduct of the User submitting any such Content.
4.12 Enforcement of these Terms of Use is solely in our discretion, and failure to enforce the Terms of Use in some instances does not constitute a waiver of our right to enforce them in other instances.
4.13 In addition, these Terms of Use do not create any private right of action on the part of any third party or any reasonable expectation that the website will not contain any content that is prohibited by these Terms of Use.
4.14 You understand that PropertyWikia does not endorse or warrant any particular content or information available via the website or guarantee the accuracy, integrity or quality of such content or information.
4.15 Additionally, we cannot guarantee the authenticity of any data which users may provide about themselves.
4.16 You acknowledge that by using the Service, you may be exposed to User Content that is offensive, indecent or objectionable and under no circumstances will you hold PropertyWikia liable in any way for any User Content, including, but not limited to, any errors or omissions in any User Content, or any loss or damage of any kind incurred as a result of the use of any User Content posted, emailed, transmitted or otherwise made available via the website or the Service. You use the Website and the Services at your own risk.
4.17 By listing a property for sale/rent the owner agrees to the terms and conditions published at the bottom of the property listing form inside their members area. By publishing a property on PropertyWikia means the owner has read, understood and accepted the terms and conditions of listing, a copy of which is listed here:
4.17 (a) Owners are permitted to list only one property for FREE every 6 months, and if a seller or landlord lists more than the permitted limit all listings will be de-listed or have each their respective 12 week guarantees invalidated without notice.
4.17 (b) Property listings made by Sellers, Landlords or Estate Agents/Realtors do not payout any commission whatsoever.
4.17 (c) Property listings are FREE and there are no fees or sales commission to pay PropertyWikia upon sale of a property.
4.17 (d) PropertyWikia GUARANTEES to ‘SELL’ or rent property within 12 weeks from the time a property is published providing that the 12 weeks is an interrupted period of time not less than 12 weeks and subject to term 4.17 of this user agreement/contract.
4.17 (e) If PropertyWikia do not sell/rent an owner's property within 12 weeks PropertyWikia will pay $162.00 USD Compensation to the owner doe a maximum of twenty-four (24) months providing the owner complies with term 4.17 of this agreement, and if the owner does not comply with this agreement, the date of publication may be restarted.
4.17 (f) If a seller or landlord edits their listing once it has been published will renew the date of listing to the date of the edit and affect the start of Compensation.
4.17 (g) Weekly $162.00 USD Compensation payments will appear in the owner's ‘My Compensation Page’ and paid out when the owner is owed $3,240.00 USD or when they delist their property or PropertyWikia sells the property whichever happens first.
4.17 (h) If a property is purposely over priced and/or an owner refuses offers for the price being advertised, then compensation may be voided and the listing de-listed without prior notice.
4.17 (i) PropertyWikia make random checks in order to authenticate property listings and owners, and if a seller/landlord fails to respond accordingly within 72 hours to a notification email, the owner's property may be suspended, deactivated or delisted and/or their 12 week time restarted and/or compensation and guarantee invalidated.
4.17 (j) The seller's or landlord's 12 week guarantee and Compensation will be voided if the seller or landlord fails to respond to a buyer/tenant enquiry within 72 hours of an enquiry being made by them through the Negotiator.
4.17 (k) The seller's or landlord's 12 week guarantee and Compensation will be voided if the seller or landlord does not accept an offer equal to the asking price.
4.17 (l) The seller's or landlord's 12 week guarantee and Compensation will be voided if the seller or landlord fails any security check or any other reasonable requirement required to qualify the seller/landlord as a responsible seller/landlord.
4.17 (m) The seller's or landlord's 12 week guarantee and Compensation is valid and payable subject to these terms and conditions in 4.17 of this agreement.
4.17 (n) PropertyWikia pays the buyer’s legal expenses, surveyor's fee and 50% of their removals cost when they buy a seller's property through PropertyWikia, providing that the buyer uses the Negotiator from start to completion and provides legitimate prepaid receipts for the services and the value of the costs are the normal cost based on an average of three (3) local estimates.
4.17 (o) PropertyWikia will not pay the buyer’s legal expenses, surveyor's fee and 50% of their removals cost if they do not conduct and complete their purchase through PropertyWikia's 'Negotiator'.
4.17 (p) Property must be listed for sale/rent at ‘current local market price’ and not over-priced to prevent it from selling to purposely collect weekly Compensation from PropertyWikia.
4.17 (q) Sellers and landlords must list their property correctly, truthfully and with the full intention of helping PropertyWikia to sell it within 12 weeks.
4.17 (r) PropertyWikia are permitted by the seller/landlord to de-list their property without notice and without liability if the seller/landlord falsifies property details, list a property that is not owned by them or incorrectly list their property to include obvious overpricing, prevent PropertyWikia from selling their property and/or list their property using; abusive; vulgar; obscene; offensive; defamatory content or cheat in any way.
4.17 (s) All listings listed on PropertyWikia are subject to these terms and conditions of use (TOU) and service (TOS) at all times.
4.17 (t) It is the seller's/landlord's sole responsibility to make a quality listing to give PropertyWikia the best tool to help them market and sell/rent property and by publishing a property on PropertyWikia, the seller/landlord agrees that the sale/rental depends upon the amount of information they provide, its quality and accurateness and if a property listing is below standard it may not sell in the 12 weeks and under such circumstances the 12 week guarantee can be invalidated without liability.
4.17 (u) Sellers and landlords cannot include any contact details in their listing.
4.17 (v) Sellers and landlords give PropertyWikia full permission to remove/edit my listing if any of these terms are broken.
4.17 (w) Sellers and landlords understand that upon ‘the sale’ of my property they must confirm the sale of their property in order to signal payment of Commission to the affiliate that introduced them and validate the buyer/tenant legal costs.
4.17 (x) If the seller/landlord transacts any part of their sale/rental and/or negotiation from the same location and/or computer as the buyer/tenant or the introducing affiliate, the buyer/tenant will lose their guarantee and the seller's/landlord's property de-listed and/or their 12 week guarantee voided as per term 4.18 (d).
4.17 (y) If a user reports a seller's/landlord's property listing for any of the available reasons published on the report function/s of the PropertyWikia website the listing will be removed from content immediately and de-listed, and invalid for compensation until the seller/landlord checks the listing and/or edits it and then only will the listing be permitted to be re-published, and then the re-published date will be the date of the re-publishing of the property listing relating to published date, 12 weeks guarantee and compensation commencement date, and the seller/landlord agrees to this and removes any liability whatsoever from PropertyWikia in the event by registering and listing their property.

4.18 By registering to buy/rent property through PropertyWikia the buyer/tenant agrees to the terms and conditions published at the bottom of the registration form and these terms and conditions as one and on the whole. By registering with PropertyWikia means the buyer/tenant has read, understood and accepted the terms and conditions of being a buyer:

4.18 (a) To validate the buyer's guarantee, the buyer must commence and complete the buying process through PropertyWikia and must follow every step of the buying process using the PropertyWikia negotiator. Furthermore, the seller and buyer must both confirm that the sale has been completed and the title of the property sold transferred to the buyer and a copy of the old and new title deeds provided to PropertyWikia on request.
4.18 (b) If any of the negotiating parties mentioned in 4.18 of these terms and conditions transact any part of the buying or sales process/rental or rental process outside of the negotiator the buyer's/tenant's guarantee and purchase will be voided together with the seller's/landlord's guarantee.
4.18 (c) If the seller/landlord transacts any part of their sale/rental and/or negotiation from the same location and/or computer as the buyer/tenant or the introducing affiliate, the buyer/tenant will lose their guarantee and the seller's/landlord's property de-listed and/or their 12 week guarantee voided.
4.18 (d) If the seller/landlord transacts any part of their sale and/or negotiation from the same location and/or computer as the buyer/tenant or the introducing affiliate, the buyer/tenant will lose their guarantee and the seller's/landlord's property de-listed and/or their 12 week guarantee voided.
4.18 (e) The buyer's basic legal expenses relating to the title transfer of the property they bought will be paid on provision of a certified and paid bill and proof of payment on completion of title transfer providing the buyer instructed a certified legal representative and subject to the validation of their guarantee, the registered address as billing address and the bought property address as the bought property details appearing on the bill and also subject to confirmation/verification and these terms.
4.18 (f) The buyer's basic survey or home inspection relating to the property they bought will be paid on provision of a certified and paid bill and proof of payment on completion of title transfer providing the buyer instructed a certified surveyor/home inspector and subject to the validation of their guarantee, the registered address as billing address and the bought property address as the surveyed/inspected property details appearing on the bill and also subject to confirmation/verification and these terms.
4.18 (g) Half of the buyer's move costs/removal costs relating to a furniture collection and delivery (not packaging or any other product or service) from the buyer's registered address to the bought property's address will be paid on provision of a certified and paid bill and proof of payment on completion of title transfer providing the buyer instructed a certified removals/move company and both registered and bought/new title address are in the same country and subject to the validation of their guarantee, the registered address being the collection and billing address and the bought property address as the delivered to address appearing on the bill and also subject to confirmation/verification and these terms.
4.18 (h) To validate the tenant's guarantee, the tenant must commence and complete the rental process through PropertyWikia and must follow every step of the rental process using the PropertyWikia negotiator. Furthermore, the landlord and tenant must both confirm that the rental has been completed and the signed tenancy agreement and a copy of rental deposit and advance rent receipt provided to PropertyWikia on request.
4.18 (i) Half of the tenant's move costs/removal costs relating to a furniture collection and delivery (not packaging or any other product or service) from the tenant's registered address to the rented property's address will be paid on provision of a certified and paid bill and proof of payment on completion of tenancy agreement/contract and payments as stated in term 4.18(h) of this agreement and providing the tenant instructed a certified removals/move company and both registered and rented/new address are in the same country and subject to the validation of their guarantee, the registered address being the collection and billing address and the rented property address as the delivered to address appearing on the bill and also subject to confirmation/verification and these terms.
4.18 (j) PropertyWikia will confirm all bills relating to the buyer's/tenant's guarantee provided to PropertyWikia by the buyer/tenant are bills for services already carried out subject to these terms and reasonably priced and if any bill is overpriced PropertyWikia can offer to pay the market price with the buyer/tenant paying the difference.
4.18 (k) If a buyer/tenant does not follow the on-screen negotiator's steps and process during negotiation the buyer's/tenant's guarantee and/or purchase/rental will be voided meaning PropertyWikia will not pay the buyer's legal expenses, survey/home inspection and/or 50% of their removal's cost and in the case of a tenant, PropertyWikia will not pay 50% of their removal's cost.

4.19 By registering as an agent/estate agent/realtor through PropertyWikia the agent/estate agent/realtor agrees to the terms and conditions published on the registration form and these terms and conditions as one and on the whole. By registering with PropertyWikia means the agent/estate agent/realtor has read, understood and accepted the terms and conditions of being an agent/estate agent/realtor:

4.19 (a) The registrant of the agent/estate agent/realtor account must be the owner, Director, partner or a fully authorised employee of the agency being registered and empowered to register as an agent for PropertyWikia. Further, the registrant cannot be the introducing affiliate or any other affiliate of PropertyWikia, and furthermore, the registrant, if an employee, cannot be a contractor, commission only operative or freelancer working for the agent/realtor, and the employee must be able to provide PropertyWikia a legal and official contract of employment and any other reasonable proof of employment evidence on request.
4.19 (b) The registrant of the agent/estate agent/realtor account must operate a dedicated property website to prove they are an agent/realtor.
4.19 (c) The registrant must register with PropertyWikia using an email address that contains the domain name of the property website as required in term 4.19 (b) to prove the registrant controls the website.
4.19 (d) The domain name of the website required in 4.19 (b) must be registered to the registrant's name, company name and registered agent/realtor address.
4.19 (e) The properties listed by the registrant and/or agent/estate agent/realtor must be displayed on their website required in term 4.19 (b) of this agreement, and the properties must be visible on of linked from the home page within the domain name registered as required in term 4.19 (b) of this agreement.
4.19 (f) The website required in term 4.19 (b) of this agreement cannot be solely part of a MLS feed showing only MLS properties. The agent's PropertyWikia listings must be visible on the registrant's website separate to any MLS listings/feed if the website is part of a MLS network, and the agent/estate agent/realtor must provide direct URLs/links showing each property listed on the PropertyWikia website on their registered website upon request.
4.19 (g) Each agent/estate agent/realtor listing on PropertyWikia must be supported by a client contract showing the agent/realtor has the right and permission to advertise, sell and represent owners at all times, and PropertyWikia must be able to inspect each unique client contract on request.
4.19 (h) The registrant themselves or the agent/estate agent/realtor company must be able to provide evidence that their company is licensed to trade as a real estate/property agent enabled to sell the properties they have listed and in the location each property is located, and the evidence must be available for inspection by PropertyWikia upon request.
4.19 (i) The agent/estate agent/realtor must start listing property within 24 hours of registering and reach a listing float of thirty (30) properties within seven (7) days of registering, and keep a minimum float of 30 properties listed at any one time, and list a minimum of 60% of their stock within 28 days, and keep the registered contact details up-to-date, and update their ask/voices profile with company details and a logo within 24 hours of joining to promote a professional image.
4.19 (j) If the agent/estate agent/realtor cannot comply with the terms of this agreement especially 4.19 the agent/estate agent/realtor account may be suspended until compliance is achieved or the account may be terminated and properties de-listed without liability or notice or the agent/estate agent/realtor may be suspended until compliance and their property listings restarted to match the date of compliance without liability or notice, and by registering as an agent/estate agent/realtor signifies that the registrant/agent/estate agent/realtor has read, understood, agreed and permitted PropertyWikia to act under these terms and conditions without liability to PropertyWikia.
4.19 (i) The agent/estate agent/realtor must start listing property within 24 hours of registering and reach a listing float of thirty (30) properties within seven (7) days of registering, and keep a minimum float of 30 properties listed at any one time, and list a minimum of 60% of their stock within 28 days, and keep the registered contact details up-to-date, and update their ask/voices profile with company details and a logo within 24 hours of joining to promote a professional image.
4.19 (j) If the agent/estate agent/realtor cannot comply with the terms of this agreement especially 4.19 the agent/estate agent/realtor account may be suspended until compliance is achieved or the account may be terminated and properties de-listed without liability or notice or the agent/estate agent/realtor may be suspended until compliance and their property listings restarted to match the date of compliance without liability or notice, and by registering as an agent/estate agent/realtor signifies that the registrant/agent/estate agent/realtor has read, understood, agreed and permitted PropertyWikia to act under these terms and conditions without liability to PropertyWikia.
4.19 (k) The agent/realtor must delete any property listed on their account that they have sold or rented rent by any means other than through PropertyWikia to a registered PropertyWikia buyer or tenant, and the deletion must occur the same-day.
4.19 (l) The agent/realtor must delete any property listed on their account that has been delisted by their client and the deletion must occur the same-day.
4.19 (m) If the agent/realtor leaves previously sold/rented or delisted properties on PropertyWikia as identified in these terms and conditions in terms 4.19 (k) and 4.19 (l) PropertyWikia will terminate this agreement and the agent account and automatically delist all properties listed by them without notice and the agent/realtor permits this action upon listing their first property and furthermore the agent/realtor agrees that PropertyWikia is not liable for any loss of income or otherwise for the action.

5. Modification of PropertyWikia Services

5.1 PropertyWikia reserves the right to modify or discontinue the Service or a portion or attribute thereof, or the offering of any information, good, content, product or service with or without notice. PropertyWikia shall not be liable to you or any third party should PropertyWikia exercise its right to modify or discontinue the Service or part of it.
5.1 (a) New applicants registering as an affiliate after 1st December 2011 will not be awarded the affiliate NFIG guarantee, and further new affiliate will not be able to register as an affiliate from the 1st December 2011.
5.1 (b) New applicants registering as a seller or landlord after 1st January 2012 will not be awarded their respective guarantee and PropertyWikia will no longer guarantee to sell/rent thier property listing within 12 weeks and/or pay Compensation.
5.1 (c) New applicants registering as a buyer or tenant after 1st January 2012 will not be awarded their respective guarantee and PropertyWikia will no longer offer to pay 50% of their moving costs and in the case of buyers PropertyWikia will not pay their legal expenses or surveyor costs neither.

6. Copyright & License

6.1 All copyrighted and copyrightable materials on this website, including, without limitation, the design, text, search results, graphics, images, pictures, sound files and other files, and the selection and arrangement and compilation of information ("Materials") thereof are proprietary property of PropertyWikia or its users and are protected by international copyright laws.
6.2 You are granted limited right to access this website, use the Services and print the Materials for your personal, non-commercial, and informational use only.
6.3 We reserve the right, without notice and in our sole discretion, to terminate your license to use the website, and to block or prevent future access to and use of the website.
6.4 The foregoing license grant does NOT include the right for you to:
  • 6.4 (A) Publish, publicly perform or display, or distribute to any third party any Materials, including reproduction on any computer network or broadcast or publications media.
  • 6.4 (B) Market, sell or make commercial use of the website or any Materials.
  • 6.4 (C) Systematically collect and use of any data or content including the use of any data spiders, robots, or similar data gathering, mining or extraction methods.
  • 6.4 (D) Use, frame or utilise framing techniques to enclose any portion of this website to include the images found at this website or any text or the layout/design of any page or form contained on a page.
6.5 PropertyWikia does not assert copyright or grant any rights to the images or descriptions of property listings that are contained in our search results. PropertyWikia uses these images and descriptions solely to generate search results.

7. Trademarks And Service Marks

7.1 "PropertyWikia" and our logos are either trademarks, service marks or registered trademarks of PropertyWikia and may not be copied, imitated or used, in whole or in part, without our prior written permission.
7.2 You may not use any meta tags or any other "hidden text" utilising "PropertyWikia" or any other name, trademark, or product name of PropertyWikia without our permission.
7.3 In addition, all page headers, custom graphics, button icons, and scripts are service marks, trademarks of PropertyWikia and may not be copied, imitated, or used, in whole or in part, without our prior written permission.

8. Links to Other Websites

8.1 The Services contain links to third-party websites. These third-party sites are not under the control of PropertyWikia. We are providing these links to you only as a convenience, and the inclusion of any link does not imply affiliation, endorsement, or adoption by us of the site or any information contained therein.
8.2 PropertyWikia is not responsible or liable for the contents of any linked site.
8.3 When leaving this website, you should be aware that our terms and policies no longer govern, and, therefore, you should review the applicable terms and policies, including privacy and data gathering practices, of that website.

9. Information Provided by Real Estate Professionals

9.1 If you are a real estate professional, you agree that you will not claim or submit listings that do not belong to you.

10. Digital Millennium Copyright Act Compliance

10.1 In accordance with the provisions of the Digital Millennium Copyright Act (DMCA), PropertyWikia has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, subscribers or account holders who are deemed to be repeat infringers. If you believe that your work has been copied and has been posted to this website in a way that constitutes copyright infringement, please provide PropertyWikia's copyright agent the following written information:
  • 10.1 (A) - An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright interest.
  • 10.1 (B) - A description of the copyrighted work that you claim has been infringed upon.
  • 10.1 (C) - A URL and description of where the material that you claim is infringing is located on the website.
  • 10.1 (D) - Your address, telephone number and e-mail address.
